Resumo

O artigo busca realizar um esforço sintético no sentido de aproximar e correlacionar o tema do pluralismo jurídico, o conceito de juridicidade, tal como tratado notadamente por Étienne Le Roy, e a proposta de constituição de uma teoria jurídica intercultural, esboçada por Christoph Eberhard, três tópicos de destacado interesse no atual panorama das abordagens antropológicas do fenômeno jurídico. Traça um breve retrospecto do surgimento e da evolução da antropologia jurídica, passa em seguida ao estudo do pluralismo jurídico e da ideia de juridicidade e ruma à análise do horizonte da aspirada teoria jurídica intercultural, em seus aspectos epistemológicos e metodológicos, encerrando com as conclusões obtidas no exame da matéria. Utiliza preferencialmente os métodos histórico-evolutivo, histórico-comparativo, comparativo e dialético.

Legal pluralism, juridicity and intercultural legal theory in the current scenery of legal anthropology

Abstract

The paper aims to accomplish a synthetic effort in order to approximate and correlate the theme of legal pluralism, the concept of juridicity, as treated notably by Étienne Le Roy, and the proposed constitution of an intercultural legal theory, outlined by Christoph Eberhard, three topics of outstanding interest in the current scenery of the anthropological approaches to the legal phenomenon. It traces a brief foreshortening of the emergence and evolution of legal anthropology, then passes to the study of legal pluralism and the idea of juridicity and heads to analyze the aspirated intercultural legal theory’s horizon, in its epistemological and methodological aspects, ending with the conclusions reached in examining the subject. It uses preferably the historical-evolutionary, the historical-comparative, the comparative and the dialectical methods.
