Resumo

O presente estudo articula uma análise hermenêutica crítica do constitucionalismo da modernidade e seus evidentes esgotamentos. Com marco teórico na obra de Ricardo Sanín Restrepo, “Teoria Crítica Constitucional”, este ensaio analisa a questão da legitimação do direito e justificação de existência do Estado dentro da Modernidade Liberal, analisando os conceitos “universais” basilares de que a mesma se serve para construir sua base de legitimação, tais como democracia, povo e poder constituinte. A metodologia utilizada contempla método dialético e materialismo histórico, com a desconstrução hermenêutica dos conceitos “universais”, devido à negação e exclusão sistemática de contextos de realidade que os mesmos promovem. Na sequência, leva-se a cabo a reconstrução hermenêutica dos conceitos de povo e democracia, atentando justamente para as realidades que o sistema liberal excluiu e negou.

Decolonial hermeneutics: revealing the exhaustion of the legal and political speech of liberalism

Abstract

This essay articulates a critical hermeneutic analysis of modernity´s constitutionalism and its evident exhaustion. With theoretical framework in the work of Ricardo Sanin Restrepo, "Critical Constitutional Theory", this paper will address the question of law´s legitimacy and the State´s justification of existence within the Liberal modernity, analyzing the "universal" basic concepts that modernity uses to build its legitimation base, such as democracy, the people and constituent power. The methodology of this study includes the dialectical method and historical materialism, with the hermeneutic deconstruction of the "universal" concepts of modernity, due to its systematic denial and exclusion of reality contexts. As a result, this essay will carry out the hermeneutic reconstruction of the political and legal categories people and democracy, paying attention precisely to the realities that the liberal system has excluded and denied.
