Resumo

A expansão do Poder Judiciário em democracias contemporâneas o afirma como o detentor da “última palavra” sobre o significado da constituição. Teóricos do constitucionalismo popular refutam a posição assumida pelo Judiciário, afirmando que o poder último de atribuição de tal significado pertence ao Povo, titular do poder constituinte originário e fiscal da aplicação desse documento. Uma revisão bibliográfica do constitucionalismo popular e da accountability judicial permite estabelecer os limites desta em assegurar o protagonismo do Povo preconizado por aquela, e explicitar a tensão existente entre a independência judicial operada pelo judiciário empoderado e a insuficiência da accountability judicial perante a sociedade. A accountability social, expressa majoritariamente por mecanismos que favoreçam a mobilização social e o uso democrático e responsável da mídia, pode contribuir para dissipar essa tensão, mas seus mecanismos ainda são insuficientes e escassos. O incremento de ferramentas efetivas de accountability social é necessário para ampliar a legitimidade do judiciário perante a sociedade, tornando-o mais responsivo a ela e mais receptivo a respeitar o protagonismo político do Povo na atribuição do significado da Constituição.

The Contribution of Popular Constitutionalism to Strengthening Social Accountability over the Judiciary

Abstract

The Judiciary expansion in contemporary democracies defines it as the “decision-maker” on the meaning of the Constitution. Theorists of popular constitutionalism refute this Judiciary role, stating that the ultimate power of attribution of such meaning belongs to the People, holder of the original and fiscal constituent power of this document application. A review on popular constitutionalism and judicial accountability allows you to establish the limits to ensure the leading role of the people advocated for the former, and to highlight the tension between judicial independence by empowered judiciary and the lack of judicial accountability to society. Social accountability, expressed mainly by mechanisms that favor social mobilization and the democratic and responsible use of the media, may contribute to dissipate this tension, but its mechanisms are still insufficient and scarce. The increase of effective tools of social accountability is needed to increase the legitimacy of the judiciary in society, making it more responsive to it and more receptive to respect the political leadership of the People following the meaning of the Constitution.
